Terms and Conditions and General Travel Information
personal requirements
Each participant assures that they have the necessary psychological and physical requirements for the selected tour, which are listed in the catalogue, in the detailed description and in the terms and conditions. Persons impaired by medication, alcohol or drugs are excluded from the tour.
Safety/Risk
Every participant in AOS tours is aware that they are engaging in an adventure activity that cannot offer the comfort and safety of a standard package tour. Tours of the Sportagentur Strobl GmbH are led by certified tour guides. The equipment corresponds to the latest safety standards. All tours are carefully planned and prepared. Before each tour, a comprehensive introduction is given by the tour leader. However, the risks are diverse and cannot be completely ruled out. Liability for all damage and claims, regardless of the legal reason, against AOS and the tour guides is limited to gross negligence and intent. The organizer is not liable for damage resulting from activities that go beyond the booked program. The person ordering the tour expressly assures that he submitted the travel registration in the name and power of attorney of the registered travel participant. Rescue costs (emergency helicopter, mountain rescue, etc.) are to be borne by the rescuer himself, unless these are covered by the existing liability insurance of AOS.
Cancellation of the tour/exclusion of participants
The tour guide is entitled to exclude guests from the tour or cancel the tour who violate our terms and conditions, in particular who do not meet the necessary requirements for the tour. The tour guide reserves the right to change, expand or restrict the tour program due to unforeseen circumstances that may endanger the safety of the guests (e.g. excessive water level, sudden changes in the weather, insufficient skills of the participants). The organizer is entitled to withdraw from the contract if such circumstances exist.
Injuries and damage must be reported to the tour leader immediately.
tour duration
The duration of a tour cannot always be precisely determined in advance. The times given in the brochure/website are only intended as a guide.
Liability
In some cases, people travel to and from the tour areas in private vehicles. These transports are not part of our program. We therefore assume no liability for accidents and damage that arise as a result.
The organizer is only liable for the services of third parties for the proper mediation, e.g. accommodation, meals, transfers. Participation in all events is at your own risk and peril. If items of equipment are borrowed, the borrower is liable for the proper return.
Most of the tours and trips offered have a sporty and adventurous character and therefore place increased demands on fitness and health. The instructions of the tour guides must be followed.
Special conditions for AOS rafting tours:
Transport requires sufficient swimming skills in flowing water. During the journey, the passenger must ensure that the chin strap of the helmet and the life jacket fasteners are closed. Every participant has to make sure that he carries the necessary equipment for the tour. The tour leader has the right to exclude the participant from the tour if the equipment is incomplete - if this circumstance is due to negligence on the part of the participant. Smoking and making noise while driving is prohibited.
The passenger is liable for willful damage to boats and equipment.
The passenger is obliged to cooperate in transporting the boat to and from the transport vehicle.
It is the passenger's own responsibility to take extra care when getting on and off the boat because of shallows, slippery stones, different current conditions and the boat moving, which increases the risk of injury.
Special conditions for canyoning tours:
The ascent of a canyon takes place mostly in pathless terrain, where particularly slippery passages are to be expected. It must therefore be reckoned with slipping at any time. Therefore, each participant has to move particularly carefully and cautiously. The tour leader shows how to move. All areas where there is a risk of falling may only be secured and entered under the supervision of the canyoning guide. There is a risk of falling rocks in a canyon.
Each participant must ensure that eye contact with the other participants and the canyoning guide is maintained.
Special conditions for canyoning tours:

Therefore, each participant has to move very carefully and cautiously. The tour leader shows how to move. All areas where there is a risk of falling may only be secured and entered under the supervision of the canyoning guide. There is a risk of falling rocks in a canyon.

Special equipment is used on a canyoning tour. Before and during the tour, each participant receives precise training on how to use this equipment. This equipment must be handled with particular care and caution.
Jumping is only allowed with the express permission of the canyoning guide, whereby the instructions must be followed exactly. In addition, different water depths are to be expected in the water basins, which is why you are only allowed to jump into the part designated by the canyoning guide. If this is not possible from the guest's point of view, the canyoning guide must be informed, who is obliged to find alternative options for safely overcoming the difference in altitude. Each participant has to make sure that he selects a safe, non-slip jumping point and presses his hands tightly against his body when jumping and only jumps with his legs first. It is generally to be expected that the legs will touch the ground, which is why the jump must be caught with the legs. Sliding in the riverbed has to be done in a leaning back position, with your head bent forward and your hands crossed. Each participant must bring ankle-high shoes with non-slip soles suitable for walking in pathless terrain.
Each guest must ensure that the harness, helmet and carabiner are always securely fastened. Irregularities must be reported to the canyoning guide immediately. Every participant has to be considerate of other participants and, if instructed by the canyoning guide, to give them reasonable assistance.
photos and videos
Many guests want photos of the tours, which we are happy to take if possible.
We also produce photos and videos that we use for advertising purposes (website,
Facebook...). By booking our tours, you personally agree that we can also use
photos of groups in which you were part of a group for these purposes. We
undertake to only use photos that are neither suggestive nor invade the privacy
of the guest.
GENERAL TERMS AND CONDITIONS OF BUSINESS
Liability
The organizer is only liable for third-party services for the proper mediation, e.g. accommodation, meals, transfers. Participation in all events is at your own risk. If items of equipment are borrowed, the borrower is liable for the proper return. The organizer has a business liability insurance that includes all programs.
Termination due to force majeure
If the trip is made considerably more difficult, endangered or impaired as a result of force majeure that was not foreseeable when the contract was concluded, or if the safety of the customer can no longer be guaranteed, both you and we can terminate the contract after examining a possible postponement or after suggesting an equivalent alternative program. If you cancel before the start of the trip for the aforementioned reasons, you will receive a refund of the travel price paid. There is no further claim. If the aforementioned reasons arise after the start of the trip, the travel contract can be terminated by either party after examining a possible change in time or an equivalent replacement program. If the contract is terminated, we can demand reasonable compensation for the tour guides that have already been provided or are still to be provided to complete the trip. Paid tours will be refunded in the event of cancellation, vouchers remain valid.
Registration
With our booking confirmation (usually by e-mail), the travel contract is binding for both parties and the present travel conditions are recognized. The registrant expressly assures that he submits the travel registration in the name and power of attorney of all registered travel participants (group bookings).
Failure to Use Services
If the participant, for whatever reason, does not make use of the travel services, there will be no refund.
Prices
All prices include the currently valid VAT rates. All prices are per person unless otherwise stated.
Travel withdrawal, cancellations and non-attendance of trips and booked programs
In the event of cancellation, the following cancellation costs will be charged regardless of the reason for cancellation: up to 30 days before the start of the trip 10% of the total travel price, from the 29th to the 15th day 30%, from the 14th to the 3rd day 50%, from the 2nd day or in the event of no-show 100%. We recommend taking out travel cancellation insurance (European travel insurance)
Language
The general contract, order and business language is German. For translation into languages other than German, an automatic, software-based translation system is used on the website (provided by Google). The customer acknowledges that automatic translation systems do not work 100% error-free and that poor translation results can occur. rafting.at/Sportagentur Strobl cannot be held responsible for any misunderstandings resulting from inadequate translation results in languages other than German.
place of jurisdiction
The place of jurisdiction for both parties is the location of the travel service provided or our registered office.
